US Treasury Secretary Scott Bessent said on July 21 that Washington will scrutinize Chinese open weight AI models for intellectual property theft and "has the ability to sanction them." He named Moonshot AI's Kimi K3 specifically.
What was actually said
On Fox Business, Bessent said regulators are "finding watermarks of our U.S. large language models on many of the Chinese models," the underlying accusation being that Chinese labs are using distillation, training a smaller model on a larger one's outputs, to copy capability from OpenAI and Anthropic's models without licensing it. No lawsuit, sanction, or Entity List addition has actually been filed. This is a stated intent to investigate, not an enacted action.
The pushback
Microsoft CEO Satya Nadella pushed back publicly, calling the accusation hypocritical since US labs also use distillation on publicly available data as a normal part of training. That is a real technical point: distillation is a standard technique, not inherently theft, and where the line sits legally is exactly what is unresolved here.

This is a direct extension of the chip export control fight into model weights and training technique, and it lands right as Kimi K3 and other Chinese open weight models have become genuinely competitive options for cost sensitive builds.
