Oracle invokes force majeure on its New Mexico Stargate campus over power delays
Oracle sent the notice to developer Stack Infrastructure, Bloomberg reported. The campus's 2.45 gigawatts of Bloom fuel cells still wait on a delayed gas pipeline and an air permit New Mexico has not issued.
The gas pipeline meant to feed Project Jupiter's fuel cells slipped nearly six months, to February 1, 2027.
Oracle has sent a force majeure notice on Project Jupiter, its Stargate data center campus in Santa Teresa, New Mexico, over the risk that the campus's power is not ready in time. Bloomberg reported the notice first on September 24, 2026, and TechCrunch and El Paso Matters followed. The notice went to the developer, Stack Infrastructure, which Blue Owl Capital owns. The campus is due online in 2028.
Oracle is the tenant, hosting AI infrastructure for OpenAI under the Stargate program that OpenAI and SoftBank are also part of. Both outlets say the Doña Ana County campus is designed to run on 2.45 gigawatts of Bloom Energy fuel cells. Fuel cells burn natural gas, so the campus needs a gas line and a permit to run them. The gas pipeline moved to February 2027
The gas is meant to arrive through the Green Chile pipeline, built by Energy Transfer's Transwestern unit. Transwestern told federal regulators that the in-service date has moved from August 15, 2026 to February 1, 2027, The Next Web reported. That is nearly six months.
The delay comes from a short stretch of land. New Mexico Land Commissioner Stephanie Garcia Richard refused the route twice, in March and on July 15, because it crosses state trust land, according to The Next Web. El Paso Matters puts the crossing at 0.6 miles. It also reports that the Federal Energy Regulatory Commission finished its environmental assessment of the pipeline in September.
The fuel cells still have no air permit
The New Mexico Environment Department has not issued the air quality permit the fuel cells need. TechCrunch reports a November 23 deadline for that decision. Lawsuits before the New Mexico Supreme Court held up the public hearing, and El Paso Matters reports the court cleared the way in the week before September 24 for permitting to resume.
Oracle says the 2028 schedule holds
According to Bloomberg's unnamed sources, as cited by El Paso Matters, the notice lets Oracle defer rent for up to three years if the power is not ready. Oracle told TechCrunch that "Project Jupiter remains on our planned schedule." Oracle spokesman Michael Egbert told El Paso Matters that such notices "are commonplace in developments of this scale" and preserve contractual rights between partners. Blue Owl said the notice "does not change the financial commitments to this multi-year project."
No party has said the 2028 date has moved. What the reports do not settle is whether a February pipeline and a permit decided in late November leave enough time to install 2.45 gigawatts of fuel cells before then.

Oracle filed this notice to protect itself from that risk, and builders should plan for the same risk. We do not tie a product plan to a specific provider's future capacity arriving on a specific date. We keep the model provider and the region swappable, and we treat a campus announcement as a plan until its power is on.
